FanLura — Terms of Service

Welcome to FanLura. These Terms of Service (“Terms”) form a legally binding agreement between you and FanLura (“FanLura,” the “Platform,” “we,” “our,” or “us”) concerning your access to and use of FanLura.
By accessing, registering for, or using FanLura, you agree to these Terms, our Privacy Policy, and any additional rules or policies posted on the Platform. If you do not agree, you must not access or use FanLura.
FanLura is a platform for user-generated creative content, creator subscriptions, one-time content purchases, tips, messaging, and related community features. Users may act as both creators and fans. There are no separate creator and fan account types.
1. Eligibility
You must be at least 13 years old to use FanLura. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Platform.
To receive payouts, connect a Stripe account, offer paid content, receive tips, or otherwise enter into financial agreements through FanLura, you must be at least 18 years old and legally authorized to do so.
By using FanLura, you represent that you meet these eligibility requirements and are not prohibited from using the Platform under applicable law.
2. User Accounts
You must create an account to upload content, purchase paid content, subscribe to creators, send tips, use messaging, or access certain Platform features.
You are responsible for:
- Providing accurate and current account information.
- Maintaining the confidentiality of your login credentials.
- All activity occurring through your account.
- Promptly notifying us of suspected unauthorized access.
You may not:
- Impersonate another person or organization.
- Create an account using false or misleading information.
- Sell, transfer, rent, or share your account.
- Use another person’s account without permission.
- Attempt to bypass authentication or security controls.
We may require account verification or additional information where reasonably necessary for security, fraud prevention, legal compliance, or payout eligibility.
3. Acceptable Use
You agree not to use FanLura to:
- Violate any applicable law or regulation.
- Infringe the rights of another person.
- Harass, threaten, stalk, exploit, or abuse others.
- Distribute spam, scams, phishing, or deceptive content.
- Upload malware, viruses, or other harmful code.
- Attempt unauthorized access to accounts, systems, or data.
- Circumvent payments, access controls, or security measures.
- Scrape or harvest Platform data without written permission.
- Manipulate views, likes, follows, tips, purchases, or analytics.
- Use automated tools in a manner that harms the Platform.
- Interfere with the operation, availability, or security of FanLura.
4. Creator Content and Responsibilities
Creators retain ownership of the original content they upload to FanLura.
By uploading or posting content, you grant FanLura a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, process, reproduce, display, transmit, distribute, format, adapt, and promote that content solely as reasonably necessary to operate, provide, improve, secure, and promote the Platform.
This license ends when your content is deleted from our active systems, except where continued retention or use is reasonably necessary for backups, legal compliance, dispute resolution, fraud prevention, or previously authorized promotional materials.
You represent and warrant that:
- You own the content you upload or have permission to use it.
- Your content does not violate intellectual-property rights.
- Your content does not violate privacy, publicity, or contractual rights.
- Your content complies with these Terms and applicable law.
- You have obtained any necessary releases or permissions.
Creators are solely responsible for their content, descriptions, pricing, benefits, representations to fans, tax obligations, and compliance with applicable law.
5. Prohibited Content
FanLura is intended for general audiences and does not permit sexually explicit or pornographic content.
The following content is prohibited:
- Pornographic or sexually explicit content.
- Sexual acts or nudity displaying genitals.
- Child sexual abuse or exploitation material.
- Any sexualized depiction or exploitation of minors.
- Content encouraging or glorifying self-harm.
- Graphic or gratuitous violence.
- Credible threats, harassment, stalking, or intimidation.
- Hate speech or content promoting violence against protected groups.
- Terrorist, extremist, or violent criminal propaganda.
- Human trafficking, exploitation, or non-consensual content.
- Fraud, scams, phishing, or deceptive financial activity.
- Illegal drugs, weapons, stolen goods, or unlawful services.
- Malware, malicious code, or instructions intended to cause harm.
- Copyright, trademark, or other intellectual-property infringement.
- Content that violates privacy or publicity rights.
- Any content that violates local, state, federal, or international law.
Uploading, attempting to upload, distributing, or promoting prohibited content is a material breach of these Terms and may result in immediate removal, account suspension, termination, payout restrictions, and reporting to authorities where required or appropriate.
6. Payments and Stripe
FanLura uses Stripe and Stripe Connect to process purchases, subscriptions, tips, creator payouts, and related financial transactions.
FanLura does not directly store complete payment-card information. Payment processing is subject to Stripe’s applicable terms, policies, eligibility requirements, and verification procedures.
Creators must maintain an eligible Stripe account in good standing and provide accurate information required for identity verification, tax reporting, and payouts.
Transactions may also be subject to payment-processing fees, taxes, currency-conversion fees, refunds required by law, chargebacks, reversals, and other legally required deductions.
7. Platform Fees
Unless a different fee is clearly disclosed before a transaction, FanLura retains a 20% platform commission from eligible creator transactions, and the remaining 80% is allocated to the creator before any applicable Stripe fees, taxes, refunds, chargebacks, currency-conversion costs, or other required deductions.
FanLura may change its fees in the future. Material changes will be communicated through the Platform, by email, or through an updated fee disclosure before they take effect.
8. One-Time Purchases
Creators may offer individual posts or other content for a one-time purchase.
After successful payment, access is granted according to the Platform’s current access rules. Access may become unavailable if the content is removed, the creator deletes the content, the account is terminated, access is required to be restricted by law, or the Platform is discontinued.
Purchasing content does not transfer ownership or intellectual-property rights to the buyer. Purchases grant only a limited, personal, non-transferable right to access the content through FanLura while it remains available.
9. Subscriptions
Creators may offer recurring subscription plans, including Silver, Gold, Platinum, or other plans made available by the Platform.
Subscriptions automatically renew at the end of each billing period unless cancelled before the next renewal date.
By purchasing a subscription, you authorize recurring charges through the payment method associated with your account until the subscription is cancelled.
Unless otherwise stated in the subscription-management interface:
- Upgrades may take effect immediately and may include prorated charges.
- Downgrades may take effect at the next renewal date.
- Cancellation generally takes effect at the end of the current paid billing period.
- Access generally continues until the end of the current paid billing period after cancellation.
Subscription content and benefits may change over time. Creators are responsible for accurately describing their plans and benefits.
10. Tips
Users may voluntarily send tips to creators where tipping is enabled. Tips do not purchase ownership rights and do not guarantee a particular response, benefit, service, or outcome unless FanLura expressly states otherwise.
Tips are generally final and non-refundable except where required by law.
11. Refund Policy
Purchases, subscriptions, and tips are generally non-refundable except where required by applicable law.
Because digital content and subscription access may be provided immediately after payment, you acknowledge that transactions are normally final once access is delivered.
FanLura may issue refunds, credits, reversals, or other remedies at its discretion, but doing so in one case does not create an obligation to do so in another case.
Nothing in these Terms limits any non-waivable consumer rights available under applicable law.
12. Creator Earnings and Payouts
Creators are responsible for maintaining accurate payout, identity, banking, and tax information.
Payout timing is subject to Stripe’s processing schedules, account status, verification requirements, reserves, banking systems, and applicable law.
FanLura may delay, freeze, withhold, reverse, or cancel earnings connected to:
- Fraud or suspected fraud.
- Chargebacks, disputes, or payment reversals.
- Illegal activity.
- Copyright or intellectual-property violations.
- Prohibited content.
- Account or payout verification issues.
- Violations of these Terms.
- Moderation, legal, or security investigations.
Creators are solely responsible for reporting and paying taxes associated with their FanLura earnings. FanLura or Stripe may provide tax forms or report payments where required by law.
13. Fraud, Chargebacks, and Payment Abuse
You may not use stolen payment methods, manipulate transactions, initiate abusive chargebacks, circumvent fees, launder funds, artificially generate earnings, or otherwise misuse FanLura’s payment systems.
Where suspicious activity is detected, FanLura may restrict account access, suspend transactions, freeze payouts, reverse earnings where legally permitted, request verification, or terminate accounts.
14. Copyright Complaints and DMCA
FanLura respects intellectual-property rights and may remove or restrict access to content that allegedly infringes copyright.
If you believe content on FanLura infringes your copyright, send a written notice to:
Your notice should include:
- Identification of the copyrighted work.
- Identification and location of the allegedly infringing content.
- Your name and contact information.
- A statement that you have a good-faith belief that the disputed use is not authorized.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner.
- Your physical or electronic signature.
We may remove or disable access to allegedly infringing content and may terminate repeat infringers where appropriate.
A user whose content is removed may submit a valid counter-notification where permitted by law.
15. Reporting and Moderation
Users may report content or accounts believed to violate these Terms or applicable law.
FanLura may review reports, account activity, uploaded content, transaction information, and related records where reasonably necessary for moderation, security, fraud prevention, or legal compliance.
FanLura may, at its discretion:
- Remove or restrict content.
- Limit account features.
- Restrict purchases or messaging.
- Freeze or delay payouts.
- Suspend or terminate accounts.
- Preserve information as required by law.
- Report suspected illegal activity to authorities.
FanLura does not guarantee that every report will result in removal or enforcement action.
16. Platform Role and User-Generated Content
FanLura provides technology that allows users to upload, distribute, purchase, access, and interact with user-generated content.
FanLura does not endorse, guarantee, or assume responsibility for user-generated content, creator representations, or user conduct.
We do not pre-screen every upload. When we become aware of content that violates these Terms or applicable law, we may remove or restrict that content and take other appropriate action.
17. Account Suspension and Termination
FanLura may suspend, restrict, or terminate your account, with or without prior notice where permitted by law, if:
- You violate these Terms or Platform policies.
- You upload prohibited or unlawful content.
- You engage in fraud, payment abuse, or deceptive conduct.
- Your activity creates security, legal, or reputational risk.
- Required verification cannot be completed.
- We are required to act by law, court order, or a service provider.
- FanLura reserves the right to remove any content, suspend or terminate any account, restrict access to any feature, or take any other action we reasonably determine is necessary to protect the Platform, comply with applicable law, enforce these Terms, or maintain the safety, integrity, and operation of FanLura, with or without prior notice where permitted by law.
Upon suspension or termination, access to purchased content, subscriptions, messages, files, earnings, and other account features may be restricted or permanently lost.
Outstanding creator earnings, if any, remain subject to payment disputes, reserves, chargebacks, investigations, Stripe requirements, legal obligations, and these Terms.
18. Account Deletion
You may request account deletion through available account settings or by contacting support@fanlura.com.
Deleting your account may result in permanent loss of access to purchased content, subscriptions, messages, saved items, creator tools, earnings information, and other account data.
We may retain certain records where reasonably necessary for legal compliance, payment processing, tax reporting, dispute resolution, fraud prevention, security, enforcement of these Terms, or legitimate business purposes.
19. Third-Party Services
FanLura may rely on third-party services such as Stripe, Supabase, Google, Vercel, hosting providers, storage providers, and other vendors.
Your use of third-party services may be subject to their own terms and privacy policies. FanLura is not responsible for the availability, actions, security, or policies of third-party services to the fullest extent permitted by law.
20. Platform Availability and Changes
We may modify, suspend, restrict, or discontinue any part of FanLura at any time, including features, plans, pricing, storage limits, access rules, or integrations.
We do not guarantee that the Platform or any content will always be available, uninterrupted, secure, or error-free.
21. Disclaimer of Warranties
FanLura is provided on an “AS IS” and “AS AVAILABLE” basis.
To the fullest extent permitted by law, FanLura disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.
FanLura does not guarantee any level of earnings, audience growth, engagement, sales, subscriptions, or creator success.
22. Limitation of Liability
To the fullest extent permitted by law, FanLura, its owners, affiliates, employees, contractors, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, loss of goodwill, or business interruption.
To the fullest extent permitted by law, FanLura’s total aggregate liability arising from or relating to the Platform or these Terms will not exceed the greater of:
- The amount you paid directly to FanLura during the 12 months before the claim arose; or
- One hundred United States dollars ($100).
Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
23. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless FanLura, its owners, affiliates, employees, contractors, service providers, and representatives from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to:
- Your use of FanLura.
- Your content.
- Your violation of these Terms.
- Your violation of another person’s rights.
- Your fraud, misconduct, or unlawful activity.
24. Dispute Resolution and Arbitration
Before beginning formal legal proceedings, you agree to contact FanLura at support@fanlura.com and attempt to resolve the dispute informally for at least 30 days.
To the fullest extent permitted by law, disputes arising from or relating to FanLura or these Terms will be resolved through individual binding arbitration rather than in court.
Arbitration will take place in Pennsylvania unless the parties agree to another location or remote proceeding.
This arbitration requirement does not prevent either party from:
- Bringing an eligible claim in small-claims court.
- Seeking temporary or emergency injunctive relief.
- Pursuing a claim that cannot legally be subject to arbitration.
To the fullest extent permitted by law, disputes must be brought on an individual basis and not as a class, collective, consolidated, or representative action.
25. Time Limit for Claims
To the fullest extent permitted by law, any claim arising from or relating to FanLura or these Terms must be filed within one year after the claim arose. Otherwise, the claim is permanently barred.
26. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-law principles.
For disputes that are not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Pennsylvania, except where applicable law requires otherwise.
27. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we may provide notice through the Platform, by email, or by updating the effective date displayed at the top of this page.
Your continued use of FanLura after revised Terms become effective constitutes acceptance of the revised Terms.
28. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
FanLura’s failure to enforce a provision does not waive its right to enforce that provision later.
You may not assign or transfer these Terms without FanLura’s written permission. FanLura may assign these Terms as part of a merger, acquisition, financing, sale of assets, corporate reorganization, or similar transaction.
These Terms, together with the Privacy Policy and any additional posted policies, form the entire agreement between you and FanLura regarding the Platform.
